Welcome to Throttle League. These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Throttle League ("we," "us," or "our") regarding your access to and use of the Throttle League mobile application, website, and associated services (collectively, the "Services").
Acceptance of These Terms
By accessing or using any part of the Services, you agree to be bound by these Terms. If you do not agree to all of the Terms, do not use our Services.
Eligibility
You must be at least 13 years old to use our Services. If you are under the age of majority in your jurisdiction, you must have parental or guardian consent to use the Services. By using the Services, you represent and warrant that you meet the age and eligibility requirements, all registration information you submit is accurate and up to date, and you will comply with these Terms and all applicable laws.
Accounts
You may be required to create an account to access certain features. You are responsible for maintaining the confidentiality of your account and all activity under it. You agree to keep your login credentials secure, notify us immediately of unauthorized access, and not impersonate another individual or entity. We reserve the right to suspend or delete your account at our discretion if we suspect fraud, abuse, or violation of these Terms.
Acceptable Use
Throttle League is a fantasy racing and social engagement platform intended for entertainment purposes only. You agree not to violate any applicable laws or regulations, interfere with the integrity or performance of the Services, attempt to gain unauthorized access to any portion of the platform, or post or share any content that is abusive, offensive, defamatory, or illegal. We reserve the right to remove content, suspend access, or take any action necessary to maintain a safe, fair, and lawful environment.
Fantasy Pools and Competitions
Throttle League provides a variety of fantasy racing pools and competitions. All gameplay features, including Throttle Points, standings, leaderboards, and contest rewards, are for entertainment use only. We reserve the right to modify pool rules or scoring formats, cancel, reset, or reassign fantasy contests or rewards at any time, and enforce fair play and take action against cheating, collusion, or abuse. Users are responsible for ensuring they comply with local laws regarding fantasy sports and online competitions.
Virtual Currency and Purchases
Throttle League may offer virtual currency ("Throttle Points"), paid upgrades (for example, "Pro" features), and other in-app purchases. All purchases are non-refundable unless otherwise stated by law, for digital goods and services with no cash value, and subject to platform-specific terms, including Google Play or Apple App Store terms. We may change pricing, features, or availability of paid content at any time without prior notice.
Intellectual Property
All content and materials on the Services, including logos, graphics, text, game logic, and source code, are owned by or licensed to Throttle League and are protected by intellectual property laws. You may not copy, reproduce, or distribute our content without permission, reverse-engineer or decompile our software, or use our brand assets or marks without written authorization.
Third Party Services
The Services may include links or integrations with third-party services, including Firebase, Stripe, and social platforms. Throttle League is not responsible for the content, policies, or practices of those services. Use of third-party services is subject to their respective terms.
Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Services will be uninterrupted or error-free, any data, scores, or content will be accurate or timely, or any defects will be corrected.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THROTTLE LEAGUE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES. This includes but is not limited to loss of data, lost profits, and inability to access the platform. If liability is found, our total liability shall not exceed the amount paid by you, if any, to Throttle League in the past six months.
Indemnification
You agree to indemnify and hold harmless Throttle League, its affiliates, partners, and employees from any claims, damages, liabilities, costs, or expenses arising from your violation of these Terms, use of the Services, or violation of any law or third-party rights.
Suspension and Termination
We reserve the right to suspend or terminate your access to the Services at any time for any reason, including violation of these Terms. Upon termination, you lose access to your account and any associated virtual items. No refunds will be issued for unused Throttle Points or subscriptions.
Governing Law
These Terms are governed by the laws of the Province of Prince Edward Island, Canada, and applicable federal laws of Canada and/or the United States depending on your location. You consent to exclusive jurisdiction of the courts located in Canada for all disputes arising under or relating to these Terms.
Changes to These Terms
We may update these Terms at any time. When we do, we will revise the Effective Date above. Your continued use of the Services after changes means you accept the updated Terms.
Throttle League SMS Notifications Program
Throttle League may offer optional SMS notifications for selected account and fantasy motorsports pool events, including draft-room opening alerts, turn-to-pick alerts, draft or pool deadline reminders, and other selected pool notifications. The Throttle League SMS Notifications Program is operational and account-related; opting in does not provide marketing consent. SMS consent is not required to create an account or use Throttle League.
Message frequency varies. Message and data rates may apply.
To stop receiving SMS notifications, reply STOP at any time. For help, reply HELP or contact Throttle League customer support at support@throttleleague.app.
Wireless carriers are not liable for delayed or undelivered messages.
